You don't need a lawyer to start your case — it's your constitutional right

Most South Africans believe you must hire a lawyer before you can set foot in a court. That belief keeps thousands of people from enforcing valid claims — and it is wrong.

What the Constitution says

Section 34 of the Constitution of the Republic of South Africa, 1996 gives everyone the right to have any dispute that can be resolved by law decided in a fair public hearing before a court or, where appropriate, another independent and impartial tribunal.

• Section 35(3)(f) affirms the right to legal representation in criminal matters — but in civil, labour, maintenance, and family matters you may represent yourself.
• Section 9 guarantees equality before the law — access to justice cannot depend on whether you can afford R900–R5,000 per attorney hour.
• Section 28 protects children's best interests — parents can bring maintenance and care disputes without a lawyer if they follow the rules.

What self-representation actually means

Self-represented litigant (SRL) is the formal term. You prepare your own papers, file at the court counter or on CaseLines, appear at hearings, and put your evidence before the judge or commissioner. The court must still treat you fairly — but you are responsible for knowing the procedure.

• You can brief an attorney later for a single hearing or cross-examination if the matter becomes complex.
• You cannot send a friend or family member to speak for you unless they are a registered attorney or advocate (with rare exceptions).

When DIY is realistic — and when to escalate

Uncontested divorce, CCMA referrals, maintenance enquiries, debt recovery under R20,000 (Small Claims), and straightforward Labour Court matters are commonly pursued without full-time attorneys. Opposed High Court trials with expert witnesses are harder — but even then, starting as an SRL to preserve prescription and gather evidence is often the only affordable first step.
